India Dismisses US Section 301 Claims, Advocates for Resolution Through Dialogue
India has firmly rejected the United States’ allegations of unfair trade practices, calling for the immediate termination of ongoing Section 301 investigations. In a detailed submission to the U.S. Trade Representative (USTR), India denied claims related to excess manufacturing capacity and asserted that the U.S. has not provided sufficient evidence to support its allegations. The Indian government emphasized the need for bilateral negotiations to address trade concerns rather than unilateral actions.
India’s Strong Denial of Allegations
In its response to the USTR, India categorically denied all allegations outlined in the initiation notice regarding its manufacturing sectors. The Indian government argued that the notice relies on broad macroeconomic indicators without pinpointing any specific actions or policies that could be deemed “unreasonable or discriminatory” under Section 301(b) of the Trade Act of 1974. India contended that the U.S. has failed to provide a “cogent rationale” or prima facie evidence to substantiate claims of structural excess capacity that supposedly leads to a trade surplus with the United States.
India’s submission emphasized that the initiation of the investigation does not meet the legal requirements set forth in Sections 301 and 302 of the Trade Act. The government has urged the USTR to make a negative determination and terminate the investigation promptly. This strong stance reflects India’s commitment to defending its trade practices and maintaining a fair trading environment.
Call for Bilateral Negotiations
India has expressed its preference for resolving trade concerns through ongoing bilateral negotiations rather than through unilateral measures. The Indian government highlighted that both nations are currently engaged in discussions aimed at establishing a Bilateral Trade Agreement. Response to Forced Labour Allegations
In addition to addressing the allegations of unfair trade practices, India has also responded to a separate Section 301 investigation initiated on March 12 concerning the alleged failure to act against forced labour. India has stated that this investigation does not meet the legal criteria for initiation. The government has once again requested the USTR to make a negative determination and terminate this investigation as well.
India’s response to both investigations has been filed by the Ministry of Commerce and Industry on behalf of the government. The submissions include a public, non-confidential summary of India’s position, while the complete version has been submitted separately as a confidential document. This careful approach reflects India’s commitment to transparency while protecting sensitive information.
Context of the Investigations
The USTR initiated investigations into the policies and industrial practices of 16 economies, including India, China, Japan, and the European Union, on March 11. These investigations aim to examine “unfair foreign practices” that may be affecting American manufacturing. The following day, a broader probe was launched covering 60 economies, including India and China, to assess whether their practices related to forced labour imports are unreasonable or discriminatory and restrict U.S. commerce.
India’s proactive response to these investigations highlights its determination to defend its trade practices and engage in constructive dialogue with the United States. As both nations navigate these complex trade issues, the outcome of these investigations could have significant implications for their economic relationship moving forward.
