NHRC Concludes Two-Day Hearing on Human Rights Violations in Bihar

The National Human Rights Commission (NHRC), led by Chairperson Justice V. Ramasubramanian, wrapped up its two-day Bihar Open Hearing and Camp sitting in Patna. The event saw the Commission addressing over 70 reported cases of human rights violations, engaging directly with victims and relevant officials.

During the first day, the NHRC processed 30 cases, closing 19 of them after confirming that recommendations had been followed through. The State provided evidence of compensation in 10 cases, totaling over Rs. 1 crore distributed to victims’ families, representing a notable stride towards accountability and justice.

Among the significant cases discussed was one involving a female victim, where the NHRC ordered the Bihar Director General of Police (DGP) to ensure her protection, including a dedicated helpline for emergencies. Another heart-wrenching case involved the tragic rape and murder of a 10-year-old girl in Maner, leading to a recommendation for Rs. 5 lakh compensation for her next of kin. Additionally, in instances of death while in judicial custody, the NHRC highlighted negligence and recommended Rs. 15 lakh relief.

Day Two Highlights

On the second day, the NHRC shifted its focus to 10 alleged cases of bonded labour, with the Secretary of Labour and other state officials in attendance. The Commission expressed frustration over the representation by a prison official instead of the District Magistrate in one case. It also mandated a detailed report on two child labour cases.

Furthermore, in a concerning case of alleged multi-generational bonded labour, an on-site investigation was ordered. The NHRC Division Bench, comprising Justice (Dr.) Bidyut Ranjan Sarangi and Smt. Vijaya Bharathi Sayani, handled 33 additional cases, reviewing compliance and various human rights complaints.

Ten cases were closed after reviewing parties’ objections and compliance reports, with compensatory payments of Rs. 40 lakh to the families of the deceased. For five other deaths occurring in custody, the Commission noted negligence by officials and suggested further monetary compensation of Rs. 30 lakh.

Engagement with Civil Society

After the hearings, the NHRC engaged with representatives from NGOs, civil society groups, and human rights defenders, discussing vital issues across Bihar. The Chairperson acknowledged their suggestions for improved coordination with the Commission.

In a subsequent meeting with senior state officers, the NHRC tackled pressing concerns such as delayed report submissions, understanding of laws, and the identification and rehabilitation of bonded labourers. The discussions also addressed police misconduct, crimes against women and children, as well as ensuring children’s rights and welfare.

As the NHRC closed its hearing, the Chairperson commended the cooperation from state officials that facilitated relief efforts for the victims involved.
