Copyright Clash: Trimurti Films Takes Karan Johar’s Dharma Productions to Bombay HC
A legal battle has emerged just ahead of the release of the romantic comedy Tu Meri Main Tera Main Tera Tu Meri, as Trimurti Films Pvt Ltd has filed a lawsuit against Karan Johar’s Dharma Productions in the Bombay High Court. The production company alleges that the film unlawfully incorporates the iconic 1992 song ‘Saat Samundar Paar’, claiming copyright infringement. Trimurti Films is seeking damages of Rs. 10 crore and a permanent injunction to prevent the use of the song in the film, which is set to hit theaters on December 25.
Legal Action Over Copyright Infringement
In its lawsuit, Trimurti Films has named Dharma Productions and Namah Pictures Pvt Ltd as defendants, along with music label Saregama India Ltd and rapper-composer Aditya Prateek Singh, known as Badshah, who is linked to the new version of the song. The production company argues that the use of ‘Saat Samundar Paar’ infringes upon its exclusive rights to the original composition. The case is attracting significant attention due to the high-profile nature of the parties involved and the film’s upcoming release date.
The lawsuit seeks not only financial compensation but also a permanent injunction to stop any further use, adaptation, or remixing of the song in Tu Meri Main Tera Main Tera Tu Meri or any other film. This legal dispute highlights the ongoing tensions in the entertainment industry regarding the reinterpretation of classic songs, which have increasingly become the subject of copyright disputes.
The Legacy of ‘Saat Samundar Paar’
Originally featured in the 1992 film Vishwatma, ‘Saat Samundar Paar’ was a major hit, picturized on actress Divya Bharti and sung by Sadhana Sargam. Composed by Viju Shah, the song remains one of the most recognizable tracks from that era, continuing to evoke nostalgia among audiences. Its enduring popularity has made it a valuable piece of intellectual property, prompting Trimurti Films to protect its rights vigorously.
The legal action comes amid a broader trend in the music industry, where remixes and adaptations of classic songs often lead to disputes with original rights holders. As the film industry evolves, the balance between creative reinterpretation and copyright protection remains a contentious issue.
