Court Rules on Government Job Succession: Widow Ordered to Provide 25% Salary to Mother-in-Law After Remarriage

The court ruled that she must transfer 25% of her monthly salary directly to her mother-in-law’s bank account. This decision stems from her failure to fulfill her commitment to support her in-laws after securing employment on compassionate grounds.

Background of the Case

The case began after a government employee with Ajmer Vidyut Vitran Nigam died in 2017. Following his death, the company informed his family that one eligible member could receive a job under compassionate grounds. After discussions, the widow accepted the position with the understanding that she would care for her in-laws. However, she later left them without support and remarried, prompting her mother-in-law to seek legal recourse.

Court’s Rationale

The Rajasthan High Court emphasized that compassionate appointments are designed to provide financial stability to families facing the loss of their primary earner. The court clarified that the benefits of such appointments extend beyond the widow to include the deceased employee’s parents and other relatives. The widow had previously signed an affidavit promising to care for her in-laws, which she did not honor after taking the job.

The court stated that she could not abandon her in-laws after benefiting from the compassionate appointment. It ruled that her actions constituted a breach of the obligations tied to her employment, which was intended to support the entire family. The court also referenced a previous judgment to reinforce its decision.
