Amit Jani Takes On Delhi HC Ruling: Appeals to Supreme Court Over Salman Khan’s Personality Rights

Film producer Amit Jani has taken his battle to the Supreme Court, challenging a recent interim order from the Delhi High Court. This order directed the makers of “Kala Hiran: The Battle for Legacy” to remove its teaser and other promotional materials. The controversy centers around allegations that the film’s promotions infringe upon actor Salman Khan’s personality rights.
Jani, producing the film under Jani FireFox Films, is contesting the High Court’s decision made on July 27. The issue gained traction after the teaser was released on July 17, which many believe references Salman’s ongoing blackbuck poaching case.
Legal Arguments Against the High Court’s Order
According to ANI, Jani’s appeal contends that the High Court’s restraint on the teaser lacks clarity. The appeal argues that the court did not specify how Salman’s persona was allegedly misappropriated or commercially exploited.
“The present proceedings raise a question of far-reaching constitutional significance, for acceptance of the actor’s legally untenable proposition would effectively weaponise personality rights as a tool of private censorship, permitting every public personality to seek gag orders against legitimate artistic, journalistic or historical expression concerning events associated with them,” the appeal states.
Furthermore, the plea emphasizes that allowing Salman to suppress the filmmaker’s creative expression under the guise of personality rights could lead to a chilling effect on independent filmmaking, journalism, and artistic dramatization of matters that are inherently in the public domain.
Salman Khan’s Objections to the Teaser
Salman Khan has expressed his concerns by approaching the Delhi High Court, alleging that the film’s promotional material exploits his personality without his consent. His plea claims that the two-minute teaser features a fictional character named Ayan Khan, portrayed in a manner that alludes to him directly.
The actor’s objections also include references to his films “Dabangg” and “Sikandar,” alongside elements related to his pending blackbuck poaching case. The teaser reportedly depicts a courtroom trial involving a superstar accused of killing a blackbuck, complete with dramatized sequences of witness examinations and forensic findings.
In its interim order, the Delhi High Court instructed the filmmakers to remove the teaser and related promotional content, stating that it prima facie violated Salman’s personality rights and could cause irreparable harm to his reputation.
Salman Khan’s Current Projects
On the work front, Salman Khan was last seen in “Sikandar” and is set to appear in the Saudi Arabian film “7 Dogs,” which is scheduled for release in India on August 21. He is currently filming a project directed by Vamshi Paidipally and produced by Dil Raju. Additionally, Salman is attached to “Maatrubhumi: May War Rest in Peace,” which he is also producing.
