Key Insights into the Charges Against South Korea’s Impeached President

South Korea‘s former president Yoon Suk Yeol is set to receive a pivotal verdict on Friday regarding charges stemming from his controversial martial law declaration in 2024. Facing a total of eight trials, Yoon is accused of serious offenses, including abuse of power, insurrection, and violations of campaign laws. This legal battle follows a tumultuous period that saw South Korea deeply divided after Yoon’s brief and contentious decree, which has now led to significant political and social repercussions.

Insurrection Charges

Yoon Suk Yeol’s legal troubles are particularly severe due to charges of insurrection, which are among the most serious allegations he faces. Under South Korean law, sitting presidents can only be prosecuted for insurrection and treason. Yoon was charged on January 26, 2025, after parliament voted to impeach him, although he had not yet been removed from office. Prosecutors allege that Yoon attempted to undermine the constitution by declaring martial law without a legitimate reason, such as war or a national emergency.

The charges include accusations that Yoon mobilized military and police forces to seal off the National Assembly, preventing lawmakers from opposing his decree. He also allegedly ordered the arrests of key political figures, including the National Assembly speaker. Yoon defended his actions by claiming he aimed to protect the nation from “anti-state” forces sympathetic to North Korea, but many believe his motivations were rooted in his own political challenges. Prosecutors have sought the death penalty, labeling Yoon as “unrepentant,” although South Korea has not executed anyone since 1997.

Obstruction of Justice

In addition to insurrection, Yoon faces charges of obstruction of justice. He is accused of evading arrest and abusing his power by failing to convene a cabinet meeting prior to his martial law declaration. Prosecutors allege that Yoon misused state institutions for personal gain, undermining the constitutional checks and balances in place.

The arrest of Yoon was marked by chaos, requiring approximately 3,000 police officers and two attempts to take him into custody for questioning. Yoon reportedly mobilized security personnel to block the arrest, a move described by a special prosecutor as unprecedented. Yoon contended that the Corruption Investigation Office lacked jurisdiction over the insurrection charges. Experts suggest that the obstruction of justice trial is crucial for ensuring accountability for the actions taken during this tumultuous period.

Aiding an Enemy State

Another serious allegation against Yoon involves claims that he attempted to provoke North Korea into military action to justify his martial law declaration. Prosecutors have cited evidence from the phone of former military intelligence chief Yeo In-hyung, which allegedly contained messages suggesting provocations. They also referenced a memo that appeared to advocate for creating instability to seize opportunities.

This trial, which commenced recently, will examine whether Yoon ordered drone flights into North Korean territory to incite conflict. Yeo and Yoon’s former defense minister, Kim Yong-hyun, have also been indicted on similar charges, highlighting the gravity of the situation and the potential implications for national security.

Additional Allegations

Beyond the charges related to his martial law attempt, Yoon faces a range of other legal challenges. He has been accused of perjury for allegedly providing false testimony during the trial of former prime minister Han Duck-soo, who was charged with aiding the insurrection. Prosecutors claim Yoon misrepresented his intentions regarding a cabinet meeting prior to declaring martial law, asserting that he only convened it at Han’s urging.

Yoon is also among 33 individuals charged with obstructing an investigation into the death of a young marine officer in 2023. Furthermore, he faces allegations of meddling in the 2022 presidential elections and making false statements during his campaign. As these trials unfold, they will not only determine Yoon’s fate but also shape the political landscape in South Korea for years to come.
