Delhi High Court Mandates e-KYC for Domain Registrations to Combat Online Fraud

The Delhi High Court has mandated the implementation of electronic Know Your Customer (e-KYC) for all domain name registrations in a bid to combat online fraud and the proliferation of fake websites. This new requirement aims to enhance accountability among domain owners and prevent the misuse of digital identities. Additionally, the court has eliminated automatic privacy protection for domain registrants, allowing privacy options only as a paid service, thereby discouraging anonymity that can facilitate scams.
Response to Fraudulent Activities
The court’s decision comes in response to numerous complaints from well-known companies whose names and logos have been misappropriated on fraudulent websites. These deceptive sites have been reported to lure unsuspecting victims with enticing job offers, franchise deals, and dealership opportunities, often requesting upfront registration fees or deposits. Major corporations such as Tata Sky, Amul, Bajaj Finance, Dabur, Meesho, Croma, Colgate, and ITC have voiced their concerns, asserting that they have no affiliation with these fraudulent portals. The court’s ruling aims to protect consumers from such scams by ensuring that domain registrations are linked to verified identities.
Risks Associated with Domain Misuse
Justice Pratibha M. Singh highlighted the critical role that domain names play as digital identities for businesses. She pointed out that the misuse of these identities poses significant risks to consumers, emphasizing the need for robust regulations to thwart cybercriminals. The court’s ruling is designed to close existing loopholes that allow for the exploitation of domain registrations, thereby enhancing consumer protection in the digital landscape.
New Guidelines for Domain Registrars
In light of the new mandate, the High Court has issued stringent guidelines for domain registrars. Registrars are now required to maintain comprehensive owner details and secure them within a 72-hour timeframe. They must also be prepared to share this data with trademark owners, law enforcement, or investigative agencies upon request. Furthermore, domains identified as being involved in fraudulent activities must be permanently disabled to prevent their reissuance. These measures are intended to create a more transparent and accountable domain registration process.
Enhancing Online Security Measures
The court has also called on banks to bolster their verification processes during online transactions. This includes confirming beneficiary account names and monitoring for suspicious activities. Citizens are urged to verify official websites, refrain from sharing personal information, and avoid transferring money based solely on online offers. The Centre for Police Technology has welcomed the ruling, noting that linking domains to verified identities will facilitate the tracking of cybercriminals and enhance overall online security.
