Key Announcements from FM Sitharaman’s GST Council Meeting and Their Implications for Businesses

The 57th GST Council meeting has introduced significant reforms aimed at improving the ease of doing business, particularly for small enterprises. These changes, which will take effect from April 1, 2027, include measures to streamline compliance and enhance taxpayer support. Finance Minister Nirmala Sitharaman confirmed that no alterations to GST rates were made during the meeting.

Key Reforms Announced

The GST Council approved several changes designed to ease compliance burdens. Notably, the power of tax officials to make arrests will be removed, and the prosecution threshold will be raised from Rs 1 crore to Rs 5 crore. Additionally, the general penalty for non-compliance will decrease from Rs 25,000 to Rs 10,000.

The Council also recommended faster and largely automated refunds for taxpayers. Taxpayers who file returns late or make errors will face recovery, interest, and proportionate penalties, but no further actions will be taken beyond these measures. Refunds under the inverted duty structure will now extend to input services, applicable to credits availed on or after November 1, 2026.

Impact on Businesses

Experts believe that the faster refund process will significantly benefit businesses. Sohrab Bararia, Partner at Grant Thornton Bharat, noted that delays in refunds have been a major concern for working capital. He emphasized that quicker acknowledgment and sanctioning of refunds, along with the extension of inverted duty refunds to input services, could provide substantial relief to taxpayers.

Bipin Sapra, Partner and Indirect Tax Policy Leader at EY India, described these reforms as some of the most significant trade facilitation measures since the introduction of GST. He highlighted the restoration of seamless credit as a key benefit, particularly with the extension of refunds for accumulated input tax credit. The removal of arrest powers and relaxed prosecution measures signal a shift in GST administration towards greater trust, potentially leading to fewer disputes and enhanced business confidence.
