Kerala HC Division Bench Removes Stay on The Kerala Story 2: A New Chapter Unfolds

The Kerala High Court has lifted the interim stay on the release of the much-anticipated film Kerala Story 2 – Goes Beyond, allowing it to hit theaters as scheduled. This decision came after a Division Bench, comprising Justices SA Dharmadhikari and PV Balakrishnan, overturned a previous order that had halted the film’s release for 15 days. The single-judge Justice Bechu Kurian Thomas had imposed the stay, citing concerns over the Central Board of Film Certification’s (CBFC) review process.

Legal Proceedings and Initial Stay

On Thursday, Justice Thomas issued the interim stay while addressing two petitions that challenged the film’s content. He noted a potential lack of thorough consideration by the CBFC when granting the film’s certification. The petitions argued that the sequel misrepresented Kerala and could incite communal tensions. One petitioner, Sreedev Namboodiri, raised concerns about the film’s title and promotional materials, claiming they could provoke violence and unfairly stigmatize the state. He highlighted a specific line from the teaser that he interpreted as a call to confrontation.

Another petitioner, Freddie V Francis, sought a complete ban on the film, arguing that its title falsely linked Kerala with terrorism and forced religious conversion. He described the film as an example of “marketing of hate” and questioned its claims of being based on true events. Justice Thomas acknowledged the court’s general reluctance to interfere with film releases but emphasized that judicial intervention is warranted when content poses a genuine risk to communal harmony.

Division Bench’s Ruling

In response to the stay, the film’s producers appealed to the Division Bench, emphasizing the film’s scheduled international release. Senior Advocates Neeraj Kishan Kaul and Elvin Peter, representing the filmmakers, argued that the petitioners did not have the standing to file a regular writ petition, as their grievances resembled a Public Interest Litigation. They contended that the CBFC’s certification carries a strong presumption of validity and that the film includes a prominent disclaimer. The defense also pointed out that the narrative encompasses characters from various states, not just Kerala.

After an urgent hearing that lasted over two hours, the Division Bench reserved its verdict and announced the lifting of the stay on Friday afternoon. This ruling allows the film to proceed with its release as planned, marking a significant moment for the filmmakers and their supporters.
