NC JCM Appeals to PM Modi for Amendments to 8th Pay Commission Terms of Reference
The National Council (Staff Side) of the Joint Consultative Machinery (NC JCM) has formally approached Prime Minister Narendra Modi with a request to amend the Terms of Reference (ToR) for the upcoming 8th Pay Commission. The letter, which is also directed to Finance Minister Nirmala Sitharaman, emphasizes the need to reinstate the Old Pension Scheme (OPS), revise pensions for current retirees, and incorporate provisions that were part of previous pay commissions. Employee unions have been voicing similar concerns, urging the government to consider these changes for the benefit of both serving and retired personnel.
Employee Bodies Advocate for Expanded Terms of Reference
In light of the recent announcement regarding the 8th Pay Commission’s ToR, various central government employee unions have been actively communicating their demands to the government. The Confederation of Central Government Employees & Workers has also sent a letter to the finance ministry echoing these requests. NC JCM Secretary Shiva Gopal Mishra stated that revising the ToR is essential to protect the interests of both current and retired employees, including those from the Armed Forces. The collective push from these employee bodies highlights a growing concern over the adequacy of the proposed terms, which they believe do not sufficiently address the needs of government workers.
Proposed Amendments by NC JCM
The NC JCM has outlined several key amendments it wishes to see included in the ToR for the 8th Pay Commission. Among these requests is the restoration of the “expectations of stakeholders” clause, which was part of the 7th Pay Commission’s ToR. The council argues that this clause is crucial for ensuring that the voices of employees are considered in the decision-making process. Additionally, they are advocating for pension revisions for all existing pensioners and the reinstatement of the Old Pension Scheme for approximately 26 lakh employees currently enrolled in the National Pension System (NPS). Other requests include the removal of the phrase “unfunded cost of non-contributory pension schemes,” the declaration of January 1, 2026, as the effective date for the new recommendations, and a 20% interim relief for employees and pensioners to help mitigate inflationary pressures.
Concerns Over Missing Clauses and Pension Revisions
The NC JCM has expressed particular concern regarding the absence of the “stakeholders” clause in the new ToR, which they believe sends a negative message to employees. They argue that this omission could undermine the trust and engagement of government workers in the pay commission process. Furthermore, while the government has indicated that the 8th Pay Commission will address pensioners, the current ToR lacks explicit provisions for pension revisions. The NC JCM has requested the inclusion of measures such as restoring commutation after 11 years, implementing a 5% additional pension every five years post-retirement, and ensuring comprehensive revision coverage for all pensioners.
Restoration of the Old Pension Scheme and Other Key Issues
The NC JCM’s letter also emphasizes the need to restore the Old Pension Scheme for employees who joined government service after January 1, 2004. This demand reflects ongoing concerns about financial security in retirement. Additionally, the council has criticized the inclusion of the phrase “unfunded cost of non-contributory pension schemes” in the ToR, arguing that it unjustly characterizes pension rights as fiscal burdens. They are calling for the removal of this phrase to better reflect the constitutional guarantees of pension rights. Lastly, the NC JCM is advocating for the 8th Pay Commission’s recommendations to take effect from January 1, 2026, along with a 20% interim increase in basic pay and pensions to assist employees during the interim period until the commission’s report is finalized.
