US Identifies India in Section 301 Findings During Trade Deal Discussions, Suggests Additional Tariffs
Amid ongoing trade negotiations between India and the United States, the Office of the United States Trade Representative (USTR) has identified India as one of the countries engaging in unfair trade practices. The USTR’s findings have led to a proposal for additional tariffs ranging from 10% to 12.5% on imports from countries deemed non-compliant. This announcement coincides with a three-day round of discussions in New Delhi aimed at advancing a bilateral trade agreement.
USTR’s Findings
The USTR’s report stems from 60 investigations conducted under Section 301, which found that India, along with 53 other economies, lacks sufficient measures to prevent the import of goods allegedly produced using forced labor. The USTR stated that countries enforcing a ban on such imports or committing to implement reciprocal trade measures would face a lower additional tariff of 10%. In contrast, those failing to meet these criteria would incur a higher tariff of 12.5%.
Additionally, the USTR has proposed a separate mechanism for textiles and apparel, allowing a specified volume of imports from selected economies to enter the U.S. market at a reduced tariff rate. The agency has indicated plans to pursue further trade actions based on the outcomes of these investigations.
Section 301 Explained
Section 301 of the U.S. Trade Act of 1974 grants the USTR the authority to review the trade practices of foreign governments. This provision aims to identify unfair or discriminatory measures that may burden U.S. trade interests. If an investigation reveals detrimental practices, the USTR can impose corrective actions, including higher tariffs and trade restrictions.
