Aaradhya Bachchan Case: Delhi High Court Questions Generational Impact on Bachchan Family Reputation
The Delhi High Court is currently deliberating on a significant legal case involving Aaradhya Bachchan, the daughter of actor Abhishek Bachchan and granddaughter of Bollywood icon Amitabh Bachchan. The suit addresses the circulation of allegedly misleading and defamatory content about Aaradhya online. The court is exploring critical questions regarding the reputation associated with prominent family names and the implications of fake news on intellectual property rights.
Legal Questions Raised by the Court
During a recent hearing, Justice Anup Jairam Bhambhani raised important legal questions concerning the protection of a person’s reputation. He pondered whether the reputation tied to a well-known family name could be likened to the goodwill associated with a trademark. Justice Bhambhani remarked, “The value of trademark and reputation in the trademark arises from the fact that a product or service has been rendered. Now, this is somewhat contextually different when you are talking about a person. A certain last name has a reputation because of the achievements, the eminence in a certain field of work, etc. So, does that reputation, you are couching it as virtually as a trademark, does that flow down generationally? If so, up to what point?”
The court subsequently framed three broad questions for consideration. It will examine whether a family name can retain its reputation across generations, similar to a trademark, and to what extent this protection applies. Additionally, the court will investigate whether the dissemination of fake news, particularly of a “egregiously despicable nature,” can be classified as a violation of intellectual property rights.
Aaradhya Bachchan’s Legal Action
Aaradhya Bachchan, represented by her father Abhishek Bachchan, filed the suit against several YouTube channels and unidentified individuals, referred to as John Doe defendants. The legal action aims to prevent the publication of content that allegedly damages the Bachchan family name, invades their privacy, or makes defamatory claims about Aaradhya. The suit specifically addresses multiple YouTube videos that purportedly spread false information about Aaradhya’s health, including claims that she was seriously ill and had been hospitalized, as well as rumors of her death.
In April 2023, the Delhi High Court granted an interim injunction to restrain the defendants from publishing any material concerning Aaradhya’s health. Justice C Hari Shankar emphasized the need to protect children from misleading information about their well-being, stating, “Every child is entitled to be treated with honour and respect, be she the child of a celebrity or the child of a commoner. Dissemination of misleading information relating to a child, especially as regards her physical or mental well-being, is something which is completely intolerable in law.”
Expanding Scope of Personality Rights
The latest hearing also touched upon the evolving concept of personality rights. Justice Bhambhani noted, “The concept of personality rights is acquiring amoebic proportions. Everything is personality rights. But whose personality rights?” Advocate Pravin Anand, representing Aaradhya, argued that the case involves the reputation of the entire Bachchan family. He responded to the court’s inquiries about extending trademark-like protection to personal reputation by referencing the broader implications of passing-off law.
Anand stated, “Reputation is not only in a trademark. Passing off law protects much wider than trademarks. The whole family’s pictures are used, words are used to give an impression that this young girl has died and has cancer. Both fake, causing so much of harm. Using the name Bachchan and pictures of the family. Abhishek Bachchan is also a party to the matter.
