US Tightens High-Skilled Immigration Policies as Denial Rates Rise in Key Visa Categories
For Indian tech and medical professionals, as well as global achievers aspiring to work in the United States, the landscape of immigration is becoming increasingly precarious. Recent analysis reveals a significant rise in rejection rates for high-skilled immigration categories, indicating a tightening of legal migration pathways. This shift, driven by policy changes, suggests that even the most qualified individuals may find it challenging to secure employment in the U.S.
Rising Denial Rates for Employment-Based Green Cards
The most alarming trend is the sharp increase in denial rates for employment-based green cards, particularly those aimed at highly skilled professionals. According to the National Foundation for American Policy (NFAP), the denial rate for EB-1 visas, which cater to individuals with extraordinary abilities, nearly doubled from 25.6% in the fourth quarter of fiscal year 2024 to 46.6% in the same period of fiscal year 2025. Similarly, the EB-2 National Interest Waiver (NIW) saw a significant rise in denials, climbing from 38.8% to 64.3% within the same timeframe. Over a longer span, the NIW denial rate surged from just 4.3% in fiscal year 2022 to 44.8% in fiscal year 2025. This dramatic increase occurs without any formal changes in regulations, indicating a shift in adjudication practices that raises concerns among potential applicants.
Temporary Work Visa Denials on the Rise
The tightening of immigration pathways extends to temporary work visas as well. Key categories have experienced increased denial rates, particularly towards the end of fiscal year 2025. For instance, O-1 visas, designated for individuals with extraordinary abilities in fields such as science and arts, saw denial rates rise from 5.0% in Q4 FY2024 to 7.3% in Q4 FY2025. Similarly, L-1A visas, used by multinational companies to transfer senior executives, experienced an increase from 8.0% to 9.6%. L-1B visas, which cater to employees with specialized knowledge, also saw a rise in denials from 8.1% to 9.2%. These trends suggest a growing scrutiny of temporary work visa applications, further complicating the immigration landscape for skilled professionals.
Stability of H-1B Visa Amidst Pressure
While the H-1B visa, commonly utilized by Indian IT professionals, has not seen a significant increase in denial rates—remaining stable at around 2.0% to 2.1%—it is not immune to external pressures. This stability is largely attributed to a legal settlement from 2020 that restricts changes to adjudication standards without formal rulemaking. However, policy pressures persist, including an executive order signed by former President Trump that imposes a $100,000 fee for H-1B petitions filed from outside the U.S. Additionally, the lottery selection for H-1B cap visas is now linked to wage levels, with proposals to increase wages across all tiers, adding another layer of complexity for applicants.
Backlogs and Delays Compounding Challenges
The situation is further exacerbated by increasing backlogs and delays in immigration processing. Between Q4 FY2024 and Q4 FY2025, there was a notable rise in pending I-129 petitions, which employers use to sponsor non-immigrant workers, increasing by over 54,000. The backlog for I-140 petitions, essential for employment-based green cards, also grew by 58,400. Additionally, delays in processing I-485 applications, which individuals file to adjust their status to permanent residency, continued to worsen. These growing backlogs present significant hurdles for the Indian diaspora and other skilled professionals seeking to navigate the U.S. immigration system.
