Madras HC Puts Jana Nayagan Censor Controversy on Hold, Next Hearing Set for January 21

The Madras High Court has ordered the Central Board of Film Certification (CBFC) to issue a U/A 16+ certificate for the highly anticipated Tamil film Jana Nayagan, featuring Vijay. However, the CBFC has decided to appeal this ruling, leaving the film’s release date uncertain. The producers, KVN Productions LLP, sought legal intervention after the CBFC failed to provide the necessary certification in time for the film’s scheduled release on January 9, prompting a last-minute postponement.
Legal Proceedings and Court Rulings
A single-judge bench led by Justice P. T. Asha intervened in the matter, overturning a previous directive that had referred the film to a Revising Committee. The court mandated that the CBFC immediately issue the U/A certificate, noting that the Examining Committee had already recommended this certification after certain cuts were made. Justice Asha emphasized that the objections raised by a single member of the CBFC were merely an “afterthought” and should not impede the certification process.
The CBFC, however, has appealed this decision to the Chief Justice, arguing that the single judge did not allow the board to file a counter-affidavit and exceeded the relief requested. Solicitor General Tushar Mehta contended that a single judge does not have the authority to alter the certification process and that the CBFC Chairman retains the right to refer films to the Revising Committee as per established rules.
Concerns Raised During the Hearing
During the court proceedings, senior advocates raised several procedural concerns. The producers’ counsel pointed out that the regional CBFC office had assured them on December 22, 2025, that the film would receive a U/A certificate after the required cuts were made, which the producers complied with. The High Court questioned the rationale behind setting a release date before securing the certification and why the CBFC was not given a brief period to respond to the petition officially.
The court also highlighted the importance of procedural safeguards, emphasizing that statutory bodies should be afforded the same opportunities to respond as individual litigants. Justice Asha’s ruling indicated that the CBFC Chairperson acted “without jurisdiction” by reopening the certification process after the Examining Committee had already cleared the film, in accordance with the Cinematograph Certification Rules.

While the High Court has directed the CBFC to issue the certification immediately, the ongoing appeal means that the enforcement of this order is currently stayed.
