Karnataka RERA Orders Compensation for Homebuyers as Promised Amenities Remain Undelivered
A Karnataka RERA tribunal has ordered a prominent builder to pay Rs 10 lakh in compensation to four homebuyers after a joint inspection revealed that several promised amenities were not delivered in a housing project in Bangalore North. The amenities in question included a senior citizen park, open gym, spa, amphitheatre, and sports facilities. The tribunal found that showcasing these facilities in brochures and agreements without providing them constituted misrepresentation, despite the buyers having signed sale deeds.
Details of the Case
The ruling stemmed from a complaint filed by the homebuyers, who had purchased flats for Rs 2.08 crore each and executed sale deeds in 2022. During the inspection conducted on May 14, 2026, photographic evidence confirmed that the promised amenities were incomplete. The Karnataka RERA authority noted that the builder had created expectations through marketing materials but failed to fulfill those commitments. The tribunal emphasized that the builder’s failure to deliver, even if unintentional, amounted to misrepresentation.
RERA’s Findings
Smt Maheshwari S Hiremath, the adjudicating officer, stated that while the builder is required to complete a clubhouse within 18 months of receiving a site release order from BIAAPA, only a partial release order had been issued. Therefore, the builder could not be held accountable for the incomplete clubhouse at this stage. The authority highlighted that purchasing a home is a significant investment for buyers, often involving their lifetime savings, and builders have a responsibility to meet their commitments.
The joint inspection revealed multiple deficiencies, including missing portions of the compound wall and inadequate maintenance of essential facilities. The authority noted that while some amenities, such as a children’s play area and park, were completed, many others remained unfinished. The tribunal ordered the builder to pay the compensation within 60 days, with interest accruing if the payment is delayed.
