India Unveils White Paper for Robust AI Governance Framework
The Office of the Principal Scientific Adviser (OPSA) to the Government of India has introduced a new White Paper titled “Strengthening AI Governance Through Techno-Legal Framework.” This document outlines a comprehensive strategy aimed at cultivating a trustworthy and accountable artificial intelligence (AI) ecosystem within the country.
At the heart of the White Paper is a vision for a “techno-legal” governance framework. This framework is designed to address potential risks associated with AI technology while ensuring that flexibility and innovation remain intact. Emphasizing a pro-innovation approach, the paper integrates essential legal protections, sector-specific regulations, technical controls, and institutional mechanisms to foster a robust AI environment.
During the release of the White Paper, Principal Scientific Adviser Prof. Ajay Kumar Sood remarked, “Developing a robust and responsive governance framework is not just a regulatory necessity, but a prerequisite for sustaining the momentum of technological progress. The techno-legal approach offers a viable pathway by embedding legal, technical, and institutional safeguards into AI systems by design.” His insights highlight the importance of establishing a foundational governance approach that is integrated directly into AI systems from the outset.
Key Features of the White Paper
The document elaborates on a techno-legal governance model that seamlessly incorporates governance into both the design and functioning of AI systems. Several critical areas of focus include:
- Understanding the techno-legal approach to AI governance
- Facilitating safe and trusted AI throughout its lifecycle
- Technological pathways for implementing techno-legal governance
- Considerations for executing India’s AI governance framework
- Development of techno-legal tools and compliance mechanisms
This White Paper constitutes the second installment in the White Paper Series on “Emerging Policy Priorities for India’s AI Ecosystem,” an initiative by OPSA aimed at enhancing understanding and stimulating informed discussions about critical AI policy matters. The series began with a White Paper released in December 2025 that addressed “Democratising Access to AI Infrastructure.” This earlier publication underscored the notion of AI infrastructure as a collective national asset, stressing the necessity for access to quality datasets, affordable computing resources, and alignment with Digital Public Infrastructure (DPI).
Impact on AI Governance Discourse
The series of White Papers are designed as explanatory knowledge documents meant to facilitate informed discussions surrounding various policy priorities. They are intended to help shape the evolving AI landscape and reinforce India’s influential position within global AI governance dialogues.
