According to a nine-page show-cause notice obtained by NDTV, the FDA believes that the use of the “VIMAL Elaichi” branding could mislead consumers and indirectly promote a product that is prohibited in Maharashtra.
The notice states that the advertisement “may mislead consumers” and questions whether it should be viewed solely as an advertisement for elaichi or as a form of indirect promotion for pan masala. As a result, the FDA has directed the three actors to cease their participation in the campaign and remove related promotional content from their social media accounts. They have also been asked to explain their involvement in the advertisement.
The Nature of Vimal Elaichi
Vimal Elaichi is marketed as a mouth freshener that contains cardamom and other ingredients. The FDA’s concerns do not revolve around the legality of consuming elaichi itself. Instead, the focus is on the Vimal brand identity and whether promoting this product could keep the pan masala brand visible to consumers.
This distinction is crucial because while elaichi is legal, the advertisement could still reinforce the recognition of a product that is subject to restrictions. The FDA’s notice suggests that if the use of the Vimal name is intended to “maintain, reinforce or enhance” the brand identity associated with pan masala or tobacco-related products, it could be considered surrogate promotion.
Regulatory Framework and Potential Penalties
The FDA’s scrutiny extends beyond the advertisement itself to the role of the celebrity endorsers. The authority has referenced the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022, issued by the Central Consumer Protection Authority (CCPA). These guidelines aim to ensure that endorsements are not deceptive and that endorsers conduct due diligence before promoting products.
The FDA has requested information from the actors, including copies of their endorsement agreements, campaign briefs, payment arrangements, and details of the due diligence undertaken prior to their participation. The notices are not immediate findings of legal violations but rather show-cause notices, allowing the actors to respond to the allegations.
Depending on the findings, the actors could face financial penalties ranging from Rs 10 lakhs to Rs 50 lakhs, along with potential restrictions on endorsing products for up to three years. The ultimate consequences will depend on the actors’ responses and the findings of the relevant authorities.
Maharashtra’s Stance on Pan Masala
Maharashtra has a history of strict regulatory actions against gutka and pan masala containing prohibited ingredients. In 2012, the Bombay High Court upheld the state’s restrictions on these products, considering the Food Safety and Standards Act, 2006, and the state’s order prohibiting products with ingredients such as tobacco, nicotine, and magnesium carbonate.
The latest notices are part of Maharashtra’s ongoing efforts to restrict gutka and pan masala products that fall within its food safety prohibitions.
