Delhi HC Questions Priya Sachdev’s Defense Tactics
The legal battle surrounding the alleged will of the late industrialist Sunjay Kapur has escalated in the Delhi High Court. Template Theory Under Scrutiny
The defense’s argument, presented by senior advocate Rajiv Nayar, suggested that the will was based on a template from the will of Sunjay’s mother, Rani Kapur. However, the court questioned the rationale behind a billionaire relying on his mother’s will as a model while neglecting critical details about his own family and assets. The defense’s inability to justify this approach further complicated their position, as the court noted that Rani Kapur’s will was notarized and procedurally sound, unlike Sunjay’s will, which lacked proper notarization and registration.

Another significant issue raised during the hearings involved the defense’s attempt to link the children’s expenses from divorce consent terms with a claimed benefit of Rs 2,000 crore from the RK Family Trust. While Priya’s team argued that these matters were interchangeable, court records indicated that the payments under the consent terms were mandatory obligations that now fall under the estate’s responsibility. Despite claims of substantial trust benefits, no funds have reportedly been transferred to the children, raising further doubts about the defense’s assertions. The court revisited several unresolved issues from previous hearings, including the delayed disclosure of the will and attempts to secure signatures before its release. Priya Kapur’s counsel struggled to provide satisfactory answers to these concerns, reinforcing the bench’s observations that the defense has not clarified the document’s errors or established Sunjay Kapur’s involvement in its creation.
