Maritime Regulator Intervenes to Address ‘Opportunistic Pricing’ Practices by Shipping Companies

Amid rising concerns over excessive and opaque pricing practices by shipping lines, India’s maritime regulator has taken decisive action to promote transparency in the industry. On Monday, the Directorate General of Shipping (DG Shipping) issued a circular urging shipping companies and agents to avoid “predatory, non-transparent, and opportunistic pricing.” This move comes in response to complaints from exporters regarding retrospective surcharges that can significantly inflate shipping costs, particularly for perishables. The DG Shipping has committed to addressing these issues to protect exporters from undue financial burdens.

Regulatory Measures for Pricing Transparency

The DG Shipping’s recent directive aims to ensure that all shipping charges are communicated clearly and upfront to exporters. This initiative is part of a broader effort to prevent profiteering in the maritime sector. The regulator has emphasized that it will not be setting prices but will instead advise shipping lines against exploiting the current market situation. This advisory is rooted in the Merchant Shipping Act, which mandates transparency in shipping charges. The move is expected to foster a more equitable environment for exporters who have been grappling with unexpected costs.

During a recent meeting convened by the DG Shipping, exporters raised significant concerns about the retrospective war surcharge imposed by shipping companies. These surcharges can reach as high as $4,000 for perishables and $3,000 for every 40-foot container. Ajay Sahai, the director general of the Federation of Indian Export Organisations (FIEO), highlighted that these levies are being applied to vessels that had already arrived before the surcharge was implemented, creating an unnecessary financial strain on exporters.

Challenges with Foreign Flagged Vessels

Despite the DG Shipping’s efforts, implementing these regulations may prove challenging, particularly concerning foreign-flagged vessels. Exporters have expressed concerns about the difficulties in enforcing the new pricing transparency measures on these ships. An industry source noted that shipping lines are currently demanding payments for perishable goods that are delayed and at risk of spoiling upon arrival. This situation complicates logistics and raises questions about the viability of transporting essential goods.

Moreover, exporters have reported issues with shipping lines abandoning goods at ports, further complicating the situation. Sahai emphasized the logistical challenges faced by exporters in retrieving their items from these ports. The ongoing conflict in West Asia has also raised alarms, with estimates suggesting that Indian exports worth $8-10 billion could be adversely affected if the situation continues.

Impact of Rising Costs on Exports

The rising costs associated with shipping have become a pressing concern for exporters. Marine fuel prices have surged from $520 per metric tonne to $880, while insurance charges have also increased, adding to the financial burden. In light of these challenges, the FIEO has called on the government to provide support to mitigate the impact on exports. Ravikant Kapur, vice-president of FIEO, pointed out that the UAE is a crucial market for Indian exports, and disruptions could have severe consequences for trade.

To address these challenges, discussions have emerged about deploying smaller vessels or non-vessel operating common carriers to transport goods, particularly essentials, from India to West Asia. However, the viability of this solution remains uncertain due to the high operational costs. Industry stakeholders have noted that while the Emirates government is considering providing logistical support, the overall economic landscape remains precarious, and achieving pre-war shipping levels may be difficult.
