India Streamlines Food Business Regulations for Efficiency

In a significant move to simplify the regulatory landscape for food businesses, the Ministry of Health and Family Welfare has announced amendments to the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011. This update aims to create a more transparent, efficient, and business-friendly environment within the food sector, while still prioritizing vital food safety measures.

Notified as the Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2026, these changes are designed to ease compliance burden for many food operators, especially small and medium enterprises, by focusing on essential regulations.

Under the previous guidelines, all licensed food businesses needed to keep detailed records and follow strict stock rotation practices based on either the First In First Out (FIFO) or First Expiry First Out (FEFO) principles. However, with the new amendments, these stipulations will now apply exclusively to food manufacturing entities, where adherence to such practices is crucial for ensuring product safety and traceability.

Reducing the Compliance Burden

The exemption for non-manufacturing food businesses, such as retailers, is expected to substantially decrease the compliance load for these operators. This step reflects the government’s intent to lighten the regulatory strain while maintaining significant oversight on food safety where it matters most.

This amendment is part of a larger regulatory reform initiative initiated by the Ministry, which aims to enhance the ease of doing business in the food industry. Recent years have seen several innovations to simplify regulations, including the introduction of perpetual licenses, adjustments to turnover thresholds, the elimination of duplicate compliance requirements for street food vendors, and the establishment of a risk-based inspection system.

Consultative Process and Future Commitments

The amendments have been made following extensive discussions with various stakeholders across States and Union Territories, ensuring that the voices of those within the food ecosystem were heard. Aligning with recommendations from the High-Level Committee on Non-Financial Regulatory Reforms by NITI Aayog, the Ministry emphasizes the importance of reducing unnecessary regulatory burdens while enhancing effective oversight.

The Ministry of Health and Family Welfare remains dedicated to fortifying India’s food safety architecture through evidence-based regulations, ongoing stakeholder engagements, and further simplification strategies.
