IICA Completes Initial Certified Arbitration Program (ICAP) for Future Global Arbitration Professionals
The Valedictory Session of the inaugural IICA Certified Arbitration Program (ICAP) took place on October 12, 2025, at the Indian Institute of Corporate Affairs (IICA) campus in Manesar. Organized by the Centre of Excellence in Alternative Dispute Resolution (CEADR), the program aimed to cultivate a new generation of global arbitration professionals. The two-day event featured prominent speakers who emphasized the importance of strengthening the arbitration ecosystem in India to enhance investor confidence and promote effective dispute resolution.
Inauguration and Keynote Address
The event commenced on October 11, 2025, with an inauguration led by Justice Hemant Gupta, Chairperson of the India International Arbitration Centre. In his keynote address, Justice Gupta praised IICA’s efforts in bolstering the arbitration framework in India. He highlighted the significance of developing a robust alternative dispute resolution system, particularly in light of India’s rapid economic growth. Justice Gupta underscored the necessity for institutional arbitration to ensure a structured and efficient process for arbitral proceedings, which is crucial for attracting and maintaining investor trust in the Indian market.
Welcoming Dignitaries and Discussions on Arbitration
Shri Gyaneshwar Kumar Singh, Director-General and CEO of IICA, welcomed the chief guest, Dr. Rajiv Mani, Secretary of the Legislative Department at the Ministry of Law and Justice, along with guest of honor, Prof. P.K. Malhotra, former Law Secretary. In his welcome address, Shri Singh discussed various studies related to arbitration and stressed the urgent need to standardize the arbitration landscape through institutional frameworks. He also addressed challenges regarding the enforceability of arbitral awards and proposed solutions to mitigate these issues, emphasizing the importance of a supportive legal environment for arbitration in India.
Concerns and Recommendations from Experts
Prof. P.K. Malhotra acknowledged the skills and potential of arbitration professionals in India but expressed concerns about the existing gaps in the supporting ecosystem. He advocated for the establishment of the Arbitration Council of India, suggesting that necessary changes be made to enhance its effectiveness. His insights pointed to the need for a more structured approach to arbitration, which would help in addressing the challenges faced by practitioners in the field.
Valedictory Address and Conclusion
In the valedictory address, Dr. Rajiv Mani emphasized the critical role of arbitration as a dispute resolution mechanism. He referenced historical instances where arbitration was favored by the framers of the Indian Constitution during transitional periods. Dr. Mani called for a shift in mindset towards embracing alternative dispute resolution methods, such as arbitration, rather than relying solely on traditional court litigation. The session concluded with a vote of thanks from Prof. (Dr.) Naveen Sirohi, Head of CEADR, who expressed gratitude to the dignitaries for their valuable contributions and acknowledged the support of all participants and the IICA organizing team.
