Government Champions Rights of LGBTQAI+ Community with New Measures
The Central Government has reaffirmed its dedication to protecting the rights and welfare of the LGBTQAI+ community, including intersex individuals. This commitment is outlined through various legal, administrative, and welfare initiatives aimed at promoting social inclusion. In a detailed response to Smt. Rajathi during a session in the Rajya Sabha, Shri B.L. Verma, the Minister of State for Social Justice and Empowerment, elaborated on the measures being implemented by multiple Ministries to bolster LGBTQAI+ participation in critical areas like education, employment, and healthcare.
Comprehensive Multi-Ministry Approach
The Government emphasized a collaborative approach across multiple ministries to enhance protections and access to essential services for the LGBTQAI+ community. This strategy covers vital aspects such as food security, healthcare, financial services, and safeguarding against discrimination. The initiative aims to ensure dignity and safety for all community members.
Legal Framework and Protection
The Transgender Persons (Protection of Rights) Act, enacted in 2019 and amended in 2026, establishes a robust legal framework intended to protect and promote the welfare of transgender individuals. Significantly, the Act includes intersex persons within its definition, providing essential protections against discrimination and facilitating access to necessary welfare measures and entitlements.
Advisories Promoting Equality
In support of these initiatives, the Department of Food and Public Distribution has issued an advisory stating that same-sex partners can be recognized as part of the same household for ration card purposes. Additionally, the Department of Financial Services clarified that members of the LGBTQAI+ community can open joint bank accounts without restrictions, enabling partners to nominate each other for account benefits in case of death.
Healthcare Initiatives
The Ministry of Health and Family Welfare has taken substantial steps to secure healthcare rights for LGBTQAI+ individuals. These measures include prohibiting conversion therapy, enhancing access to sex reassignment surgeries, and establishing training programs for health care professionals. Furthermore, guidelines have been created to address the medical needs of infants with intersex variations, ensuring they receive appropriate care and support throughout their lives.
Safety and Rights Within Correctional Facilities
The Ministry of Home Affairs has also been proactive, issuing advisories aimed at securing prison visitation rights for LGBTQAI+ individuals. Measures have been implemented to protect them from violence, harassment, and coercion, ensuring their safety and dignity within the justice system.
