Bar Council of India Approves New Legal Education Centers
The Bar Council of India (BCI) has recently made significant strides in regulating legal education across the country. Over the past decade, the BCI has approved numerous Centers of Legal Education (CLEs) to enhance the quality of legal training in India. As of December 18, 2023, the BCI has initiated a new online application process for both existing and new CLEs. This move aims to streamline the registration process and ensure that legal education meets the required standards.
New Online Registration Process
In a circular issued on December 18, 2023, the BCI announced that it would now accept applications for CLE registration through an online portal. The designated portal can be accessed at the Bar Council of India. This new approach replaces the previous method, where hard-copy applications were accepted. The BCI has declared that all pending hard-copy applications are now considered invalid.
In the current registration cycle for the year 2023-2024, the BCI has received a total of 436 fresh applications. Notably, there are no pending applications for registration at this time. This efficient online system is expected to simplify the application process for institutions seeking to establish or maintain their status as recognized CLEs. By adopting this digital approach, the BCI aims to enhance transparency and accessibility in legal education.
BCI’s Role in Regulating Legal Education
The BCI plays a crucial role in promoting legal education in India, as mandated by Section 7(1)(h) of the Advocates Act of 1961. This section empowers the BCI to set standards for legal education and ensure that institutions adhere to these standards. Over the years, the BCI has taken various measures to address the proliferation of CLEs across the nation.
In 2015, the BCI issued a resolution requesting state governments and universities to limit the issuance of No Objection Certificates (NoCs) and affiliations to law colleges for three years. Despite this resolution, around 300 CLEs received NoCs and affiliations, which the BCI later refused to approve. Following judicial intervention, the BCI had to resume the approval process for these institutions. In 2019, the BCI imposed another three-year moratorium on the establishment of new CLEs and sections. However, this moratorium was lifted in 2021 after a ruling from the Punjab and Haryana High Court.
Current Status of CLEs in India
As of now, there are a total of 868 approved CLEs across various states in India. The distribution of these institutions varies significantly from state to state. For instance, Uttar Pradesh leads with 319 CLEs, while states like Andaman and Nicobar Islands and Dadra and Nagar Haveli have only one each.
The BCI’s efforts to regulate the number of CLEs are essential for maintaining the quality of legal education. By ensuring that only qualified institutions receive approval, the BCI aims to enhance the overall standard of legal training in the country. This is particularly important as the demand for legal professionals continues to grow in India.
