TRAI Defines International Traffic in New Recommendations

The Telecom Regulatory Authority of India (TRAI) has recently released its recommendations regarding the definition of international traffic. This move comes in response to a request from the Department of Telecommunications (DoT), part of the Ministry of Communications, Government of India. The request, dated August 30, 2022, sought TRAI’s input on defining international and domestic SMS under the TRAI Act of 1997. The recommendations aim to clarify the definitions and improve the regulatory framework governing telecommunications in India.

Background of the Recommendations

On May 2, 2023, TRAI published a consultation paper titled “Definition of International Traffic.” This paper was designed to gather feedback from various stakeholders in the telecommunications sector. The consultation process was extensive, with 20 stakeholders submitting their comments and seven providing counter-comments. To further engage with stakeholders, TRAI held an Open House Discussion on August 24, 2023. This collaborative approach ensured that the recommendations were well-informed and reflective of the industry’s needs.

The recommendations are crucial for establishing clear definitions that will guide telecommunications operators in India. By defining terms such as “International Traffic,” “International SMS Message,” “Domestic Traffic,” and “Domestic SMS,” TRAI aims to create a more transparent regulatory environment. Key Definitions Proposed by TRAI

One of the significant outcomes of the recommendations is the proposed definition of “International Traffic.” TRAI suggests that this term should be defined in relevant telecommunications service licenses as follows: “INTERNATIONAL TRAFFIC means the traffic originating in one country and terminating in another country, where one of the countries is India.” This definition is essential for distinguishing between domestic and international communications.

Additionally, TRAI has proposed a definition for “International SMS Message.” According to the recommendations, this term should be defined as “INTERNATIONAL SMS MESSAGE means the international traffic delivered using SMS.” This definition clarifies the scope of international SMS traffic and ensures that service providers understand their obligations regarding SMS communications.

Furthermore, TRAI emphasizes the importance of defining “Domestic Traffic” and “Domestic SMS.” The proposed definition for “Domestic Traffic” states: “DOMESTIC TRAFFIC means the traffic originating and terminating within India.” Similarly, “DOMESTIC SMS” is defined as “DOMESTIC SMS means the domestic traffic delivered using SMS.” These definitions will help operators differentiate between domestic and international communications effectively.
