Kumar emphasizes that the combination of policy uncertainty and evolving immigration rules has made the path to permanent residency longer and more challenging.

Indians, who represent a large share of employment-based immigrants, often rely on the Adjustment of Status (AOS) pathway to navigate green card backlogs. While experts believe that H-1B workers may not see direct impacts due to the visa’s dual-intent nature, the overall unpredictability of legal immigration pathways has raised concerns among businesses, students, and families.

Exploring Alternative Destinations

As US immigration policies tighten, many individuals are considering alternative destinations for education and employment. Countries like Germany, Australia, Singapore, the UAE, Canada, and the UK are emerging as viable options. Kuldip Kumar points out that these nations offer more predictable immigration systems and easier pathways to permanent residency. Germany, in particular, has become appealing for Indian engineers and IT professionals.

Sebin Jinny, a partner at Vialto Partners, notes that the UAE has long been a practical choice for Indians seeking a better quality of life without high taxation. The UAE Golden Visa, which offers a pathway to permanent residency through investment, has made it particularly attractive for entrepreneurs. Jinny also highlights that India’s ongoing Free Trade Agreements may reshape access to European labor markets for Indian professionals.

The Impact on the American Dream

Experts suggest that while the traditional ladder to the American Dream remains intact, some steps are now missing. Rajiv Dabhadkar emphasizes that a US degree still holds significant value, but the uncertainty surrounding post-graduation residency has made the investment less appealing for many families. For green card hopefuls, the prolonged waiting periods have shattered expectations of a long-term payoff.

Manish Daftari from Vialto Partners observes that while there hasn’t been a noticeable increase in visa denials, the administrative burden associated with visa extensions has grown. Changing regulations have also raised the prevailing wage for H-1B employees, potentially discouraging employers from sponsoring foreign nationals. Dabhadkar concludes that while the US still offers top-tier opportunities in fields like AI and biotech, the overall advantages are becoming less clear, prompting many to reconsider their options.
