Supreme Court Expansion: Government Approves Increase in Judge Numbers

The Union Cabinet, led by Prime Minister Narendra Modi, has officially endorsed the Supreme Court (Number of Judges) Amendment Bill, 2026. This legislation seeks to amend the Supreme Court (Number of Judges) Act of 1956 by increasing the number of judges in India’s highest court from 33 to 37, excluding the Chief Justice of India. This decision underscores the government’s commitment to enhancing judicial efficiency and ensuring timely delivery of justice.

Enhancing Judicial Efficiency

The proposed amendment aims to bolster the functionality of the Supreme Court. With the addition of four more judges, the court is expected to manage its caseload more effectively. This move is considered essential for addressing delays in the judicial system, allowing for quicker resolutions and promoting smoother operations within the court.

Financial Implications

The financial aspects related to the salaries and facilities for the new judges and their staff will be sourced from the Consolidated Fund of India. This strategic allocation aims to ensure that the necessary resources are in place to support the expanded judiciary without compromising existing financial commitments.

A Historical Perspective

The foundation for this amendment is rooted in Article 124 (1) of the Indian Constitution, which provides for a Supreme Court consisting of a Chief Justice and a number of other judges as determined by law. Originally, the Supreme Court (Number of Judges) Act, 1956 set the maximum number of judges (excluding the Chief Justice) at just 10.

The judicial framework has evolved over the decades. Notable amendments increased the judge count to 13 in 1960, to 17 in 1977, and further expansions in 1986 and 2008 brought the numbers to 25 and then 30. The last adjustment occurred in 2019, when the count was raised to 33. The current proposal marks another significant step in the continuous evolution of India’s judiciary.

Looking Ahead

This proposed increase in judges is a reflection of the government’s ongoing efforts to modernize and adapt the judicial system to better meet the needs of a growing population. By approving the Supreme Court (Number of Judges) Amendment Bill, 2026, the Union Cabinet demonstrates a proactive approach toward enhancing legal processes and reinforcing public confidence in the judiciary. The legislative changes await deliberation and approval in Parliament, where further discussions on the implications of these changes will take place.
