CCPA Cracks Down on Unfair Charges at Hotels and Restaurants

The Central Consumer Protection Authority (CCPA) has issued a significant advisory aimed at combating unfair practices in the hospitality sector. In response to consumer complaints and media reports, the CCPA has highlighted the prevalence of additional charges—such as “LPG charges,” “gas surcharges,” and “fuel cost recovery”—that hotels and restaurants have been imposing on customer bills. This practice, described as an unfair trade practice under the Consumer Protection Act, 2019, is seen as a breach of transparency and fair pricing in the industry.

The authority noted that these extra fees are often included automatically in bills, circumventing existing guidelines on service charges and leading to unexpected costs for consumers. In a move to protect consumer rights, the CCPA has mandated that no such charges should be automatically added to a customer’s bill, instructing that the prices reflected on menus are to be the final amounts, aside from applicable taxes.

Guidelines for Consumer Protection

Key points from the CCPA’s advisory include:

  1. No hotel or restaurant can automatically levy charges labeled as “LPG charges” or similar fees on customers’ bills.
  2. The price displayed in menus should represent the final price, excluding only applicable taxes.
  3. Consumers should not be misled or obligated to pay any charges unless they consent voluntarily.

By clarifying that any additional charges, regardless of labeling, can be perceived as service charges, the CCPA emphasizes that failing to comply with these guidelines may lead to serious repercussions under the Consumer Protection Act, 2019. This advisory echoes guidance issued on July 4, 2022, further strengthening the authority’s position on ensuring fair trade practices.

Consumer Grievance Redressal Options

Consumers facing issues with unfair charges have several recourse options. They can:

  • Request the removal of such charges from their bills directly at the establishment.
  • Report the incident by calling the National Consumer Helpline at 1915 or using the NCH mobile app.
  • File a complaint with the appropriate Consumer Commission via the e-Jagriti portal.
  • Submit a grievance to the District Collector or directly to the CCPA.

The CCPA emphasizes its commitment to monitoring these practices nationwide. Any instance of unauthorized charges by hotels and restaurants will be treated seriously, with the authority prepared to take necessary action to defend consumer interests.
