MeitY Updates IT Regulations: New Deepfake Labeling Requirements and Enhanced Social Media Oversight

In a significant step towards regulating artificial intelligence (AI) and enhancing online transparency, the Ministry of Electronics and Information Technology (MeitY) has proposed draft amendments to the IT Rules, 2021. These amendments aim to address the growing concerns surrounding AI-generated content, particularly deepfakes and synthetic media. The new rules will require social media platforms to clearly label synthetic media, ensuring users can easily differentiate between authentic and AI-generated content. Additionally, the ministry is implementing stricter oversight on content removal orders to bolster accountability.

Mandatory Labeling of Synthetic Media

The proposed amendments emphasize the need for social media platforms to adopt visible or audible labeling for synthetic media. This labeling must cover at least 10% of the visual or initial audio duration, allowing users to identify AI-generated content more effectively. Major social media intermediaries, defined as platforms with over 5 million users, will be required to obtain user declarations regarding the synthetic nature of uploaded content. Furthermore, these platforms must implement verification measures and ensure that such content includes appropriate notices or metadata identifiers. The ministry’s initiative aims to promote user awareness and enhance the traceability of content, while also fostering an environment conducive to innovation in AI technologies.

Addressing Misinformation Risks

The explanatory note released by MeitY highlights the potential dangers associated with deepfake technologies and synthetic media. It warns that these tools could be exploited to spread misinformation, damage reputations, manipulate elections, or commit financial fraud. The ministry’s proactive approach seeks to mitigate these risks by ensuring that users are well-informed about the nature of the content they encounter online. Feedback on the proposed amendments has been invited until November 6, 2025, allowing stakeholders to contribute to the discussion on how best to regulate AI-generated content.

Streamlined Content Takedown Procedures

In addition to the amendments concerning synthetic media, the IT ministry has also introduced changes to Rule 3(1)(d) of the IT Rules. These changes aim to streamline procedures for content takedown and enhance transparency in the process. Under the new regulations, only senior officials, such as those at the joint secretary rank or above, or a deputy inspector general in the case of police, will have the authority to issue takedown orders. These orders must clearly specify the legal basis, reasons, and details of the unlawful information being targeted. This shift is designed to increase government accountability and ensure that takedown actions are justified and lawful.

Ensuring Accountability and Transparency

IT Minister Ashwini Vaishnaw emphasized the importance of these changes in promoting government accountability. He stated that the new regulations would provide reasoned notifications whenever a takedown order is issued. Additionally, all takedown intimations will undergo monthly reviews by an officer not below the rank of Secretary. This review process aims to ensure that actions taken are necessary, proportionate, and lawful. The ministry asserts that these amendments strike a balance between protecting citizens’ constitutional rights and the state’s regulatory powers, reinforcing safeguards against arbitrary restrictions.
