Supreme Court to Increase Judge Count as Modi Cabinet Approves Bill
The Union Cabinet, led by Prime Minister Shri Narendra Modi, has taken a significant step towards enhancing the efficiency of the Indian judiciary. Today, the Cabinet has approved the introduction of The Supreme Court (Number of Judges) Amendment Bill, 2026, in Parliament. Historical Context
The need for more judges is grounded in the historical provisions of the Indian Constitution. Article 124(1) states that the Supreme Court shall consist of a Chief Justice and up to seven additional judges, unless Parliament decides otherwise. The original Act, passed in 1956, set the maximum number of judges at ten. This number has been amended several times since then.
In 1960, the Supreme Court’s strength was raised to 13, followed by another increase to 17 in 1977. Although a limit of 15 judges was temporarily placed until the end of 1979, the restriction was lifted thereafter. Subsequent amendments in 1986, 2008, and 2019 successively adjusted the judge count, bringing it to the current figure of 33.
