Scale AI Takes Legal Action Against Ex-Employee and Competitor Mercor for Alleged Customer Theft

Scale AI, a company specializing in preparing data for AI model training, has initiated legal action against a former employee and rival firm Mercor. The lawsuit, filed on Wednesday, alleges that the employee, Eugene Ling, took over 100 confidential documents related to Scale’s customer strategies and proprietary information before joining Mercor. The suit claims Ling attempted to pitch Mercor to one of Scale’s major clients, referred to as “Customer A,” prior to his departure.

Allegations of Trade Secret Misappropriation

Scale AI‘s lawsuit accuses Mercor of misappropriating trade secrets and claims that Ling breached his contract with Scale. The documents Ling allegedly took are said to contain critical information that would enable Mercor to serve Customer A and other significant clients of Scale. The lawsuit emphasizes the potential financial implications, suggesting that winning over Customer A could result in a contract worth millions for Mercor. In response to the allegations, Mercor co-founder Surya Midha has denied any wrongdoing, asserting that the company has no interest in Scale’s trade secrets and is operating independently.

Mercor’s Response and Investigation

Surya Midha acknowledged that while Mercor has hired several former Scale employees, including Ling, the company has not accessed any confidential data. He mentioned that Ling had informed Mercor about possessing old documents in a personal Google Drive, which the company is currently investigating. Midha stated that Mercor reached out to Scale six days ago, offering to have Ling destroy the files or find an alternative resolution, and is now waiting for Scale’s response. This proactive approach indicates Mercor’s intention to address the situation amicably.

Concerns Over Customer Relationships

Scale AI’s lawsuit highlights the company’s apprehension regarding its competitive position in the market. The suit reveals that Scale is particularly worried about Mercor’s potential to attract its clients, especially Customer A. The identity of Customer A remains undisclosed in the lawsuit, but the implications of losing this client are significant for Scale.
