Major Workforce Reform: Four Labour Codes Implemented to Simplify and Streamline Labour Laws
In a significant policy overhaul, the Indian government has announced the implementation of four consolidated labour codes, effective from November 21, 2025. These codes include the Code on Wages (2019), Industrial Relations Code (2020), Code on Social Security (2020), and the Occupational Safety, Health and Working Conditions (OSHWC) Code (2020). This initiative aims to streamline 29 existing labour laws, modernize regulations, and enhance worker protections, aligning India’s labour framework with contemporary employment structures. The government asserts that these reforms will foster a more resilient industrial ecosystem, improve workforce productivity, and support the Aatmanirbhar Bharat initiative.
Key Features of the New Labour Codes
The newly introduced labour codes bring forth several key features designed to enhance worker rights and streamline compliance for employers. One of the most notable changes is the provision for fixed-term employees, who will now receive benefits equivalent to those of permanent workers. This includes social security, medical coverage, and paid leave, with eligibility for gratuity reduced from five years to just one year. Additionally, gig and platform workers will be formally recognized under the new framework, ensuring they receive welfare benefits linked to their Aadhaar numbers, which can be accessed across states.
Moreover, the codes mandate a universal minimum wage for all workers, irrespective of their sector, and ensure timely wage payments without unauthorized deductions. Women will also benefit significantly, as they are now permitted to work night shifts in all sectors, provided they consent and safety measures are in place. The reforms aim to create a more inclusive work environment by introducing anti-discrimination provisions and expanding family definitions.
Expanded Social Security and Health Benefits
The new labour codes significantly broaden the scope of social security coverage across various industries. For the first time, the Social Security Code will extend its benefits to employees in micro, small, and medium enterprises (MSMEs), as well as those working in hazardous conditions. This includes platform workers and sectors that were previously excluded from mandatory Employee State Insurance (ESI) norms. The government has emphasized that all workers will receive a statutory minimum wage aligned with a national floor rate, ensuring fair compensation across the board.
Additionally, the codes require annual health check-ups for workers aged 40 and above, particularly in hazardous industries. This initiative aims to enhance workplace safety and health standards, ensuring that workers are protected from occupational hazards. The introduction of mandatory safety committees in large establishments further underscores the government’s commitment to improving working conditions.
Streamlined Compliance and Enhanced Worker Protections
To facilitate compliance, the new labour codes introduce a single registration and licensing framework, replacing the need for multiple filings. This change is expected to ease the administrative burden on businesses while ensuring that workers’ rights are upheld. An inspector-cum-facilitator system will be established to support compliance through advisory mechanisms rather than punitive measures.
The reforms also focus on improving protections for contract, migrant, and unorganized workers. These workers will now receive equal wages and welfare schemes, with principal employers required to ensure social security for contract staff. Furthermore, the codes stipulate that working hours in most sectors will be capped at 8 to 12 hours per day, with double wages for overtime. This is aimed at preventing exploitation and ensuring fair treatment of all workers.
