India Strengthens Oversight on Advanced Medical Technologies
In a crucial move to enhance the regulatory oversight of cutting-edge medical technologies, the Central Government has amended the Drugs Rules of 1945. This new regulation brings products derived from cell or stem cells, gene therapies, and xenografts under the management of the Centrally License Approving Authority (CLAA) framework.
The Drugs and Cosmetics Act mandates that specific categories of medicines and biological products are monitored by both Central and State regulators. Notable examples include vaccines and large-volume parenterals, as well as r-DNA based medications. With this amendment, the scope of regulatory supervision is expanded to include additional emerging technologies that have significant medical implications.
Cell or stem cell-derived products, like innovative stem cell treatments and CAR-T cell therapies, are increasingly employed in the fight against blood cancers, such as leukemias and lymphomas. Similarly, gene therapeutic products are instrumental in addressing genetic disorders and various cancers through innovative gene replacement and gene editing techniques. Moreover, xenografts, which consist of tissue from animals, such as heart valves, are crucial in medical procedures within cardiology and orthopedics.
Given the sophisticated nature and rapid evolution of these medical technologies, they require heightened regulatory oversight to ensure patient safety. By including these products within the CLAA framework, the government aims to establish a system of joint monitoring by Central and State Licensing Authorities. This measure is intended to create consistency in regulatory standards nationwide.
This amendment reinforces India’s regulatory framework, aligning it more closely with the latest scientific advancements and international best practices. It illustrates the government’s ongoing commitment to protect public health while also fostering innovation, making it easier for new technologies to integrate into the healthcare and life sciences sectors.
