Musk also played a pivotal role in recruiting key personnel and establishing essential connections that lent credibility to the nascent project. His lead trial lawyer, Steven Molo, emphasized Musk’s integral role in the company’s foundation, stating that without Musk’s involvement, OpenAI would not exist as it does today. Musk’s departure from OpenAI in 2018 led him to establish his own AI venture, xAI, which operates the chatbot Grok.
OpenAI and Microsoft’s Response
OpenAI has categorically dismissed Musk’s claims, labeling them as “unserious” and part of a “harassment campaign.” The company has previously described Musk’s lawsuit as “baseless,” asserting that there is no evidence to support his allegations. Microsoft has not publicly commented on the compensation demand but has indicated through its legal representation that it did not assist OpenAI in any wrongdoing. The ongoing legal battle is poised for trial after a judge in Oakland, California, ruled that a jury will hear the case, with proceedings expected to commence in April.
Challenges to Musk’s Damages Estimate
Both OpenAI and Microsoft have strongly contested Musk’s calculations regarding damages.
