CCI Takes Action Against Maharashtra Wine Associations for Anticompetitive Practices

The Competition Commission of India (CCI) has intervened in Maharashtra’s wine market, ordering three prominent associations to halt practices deemed anticompetitive. On December 11, 2025, the CCI determined that the Maharashtra Wine Merchants Association, Pune District Wine Merchants Association, and the Association of Progressive Liquor Vendors violated key provisions of the Competition Act, 2002.

Following a complaint under Section 19(1)(a) of the Act, the CCI examined claims that these associations conspired to set restrictions on manufacturers, distributors, and sellers of alcoholic beverages. Allegations included enforcing conditions related to retail profit margins, product launches, transportation arrangements, cash discounts, and credit terms. These practices allegedly limited fair competition within the market.

Upon review of the evidence, the Commission identified that the associations engaged in practices such as issuing circulars and communications that coerced members into adopting specific pricing structures, payment conditions, and distribution terms. This included mandatory requirements for alcohol manufacturers to acquire No Objection Certificates (NOCs) prior to the launch of new products. Such actions were found to undermine the independence of individual businesses, contravening Section 3(3)(a) and Section 3(3)(b) of the Competition Act.

Moreover, the CCI’s ruling highlighted the responsibilities of the associations’ office-bearers, who were deemed liable under Section 48 of the Act for their roles in perpetuating these anticompetitive behaviors. The case, registered as No. 43 of 2019, illustrates the CCI’s commitment to preserving competition in the market and ensuring fair practices among industry players.
