CCPA Cracks Down on Restaurants Over Service Charge Violations

The Central Consumer Protection Authority (CCPA) has launched an investigation into 27 restaurants across India for infringing on consumer rights by unlawfully imposing service charges. This decisive action comes on the heels of a ruling by the Delhi High Court, affirming that mandatory service charges are illegal and that establishments must comply with CCPA guidelines.

The court’s judgment, issued on March 28, 2025, reinforced the CCPA’s authority to enforce regulations designed to protect consumers from unfair trade practices. According to the CCPA’s guidelines set forth on July 4, 2022, restaurants cannot automatically add a service charge to bills, nor can they collect it under any other name. Consumers must be explicitly informed that payment of such charges is entirely voluntary.

Unfair Practices Uncovered

Investigation findings highlighted a troubling trend, with several prominent restaurants, such as Café Blue Bottle in Patna and China Gate Restaurant Private Limited in Mumbai, imposing a 10% service charge by default. These practices were confirmed through complaints lodged via the National Consumer Helpline (NCH) and invoices showing the unauthorized addition of service charges, violating both the Consumer Protection Act, 2019, and CCPA guidelines.

Enforcement Actions Taken

In a significant move against Café Blue Bottle in Patna, the CCPA mandated the restaurant to refund all service charges collected, cease the unlawful practice immediately, and pay a penalty of ₹30,000. Similarly, during the hearing for China Gate Restaurant in Mumbai, it was found that the establishment had already refunded charges. The CCPA then ordered the restaurant to adjust its billing system to eliminate automatic service charge additions, impose a ₹50,000 penalty, and ensure its contact email remains operational for effective consumer complaint resolution.

The CCPA remains vigilant in monitoring service charge complaints received through the National Consumer Helpline. This enforcement underscores the CCPA’s commitment to safeguarding consumer rights and curbing unfair trade practices. The authority’s actions signal a clear warning to restaurants that non-compliance will not be tolerated as consumers demand transparency and fairness in their dining experiences.
