TRAI Proposes Regulations for Foreign SIM and eSIM Card Sales

These recommendations come in response to a request from the Department of Telecommunications (DoT) under the Ministry of Communications. The Telecom Regulatory Authority of India (TRAI) has proposed a new framework for issuing and renewing No-Objection Certificates (NOCs) for the import and sale of foreign SIM and eSIM cards. This initiative aims to address regulatory gaps in the rapidly expanding Machine-to-Machine (M2M) and Internet of Things (IoT) sectors, particularly for devices manufactured for export.

New Authorization Framework for M2M SIM Services

TRAI’s proposed framework introduces a new category called the “International M2M SIM Service Authorisation.” This will enable Indian companies to legally procure and utilize foreign SIM and eSIM cards in devices intended for overseas markets. The initiative is designed to streamline the authorization process, making it entirely online. Companies registered under the Indian Companies Act will be eligible to apply for this authorization.

The proposal emphasizes a light-touch regulatory approach, which includes zero entry fees and no authorization fees. Additionally, there will be no requirements for minimum equity, net worth, or bank guarantees. Instead, applicants will only need to pay a processing fee of Rs 5,000. Once granted, the authorization will remain valid for a period of ten years, facilitating long-term planning for businesses in the sector.

Testing and Quality Assurance Measures

Recognizing the importance of testing and quality assurance, TRAI has recommended that foreign SIM and eSIM cards can remain active in India for up to six months for testing purposes. This provision is crucial for Indian companies that manufacture smart meters, connected vehicles, and industrial sensors, as they often require foreign SIMs to ensure seamless connectivity in the countries where their products are exported.

By allowing these cards to be tested in India, TRAI aims to enhance the reliability and performance of IoT-enabled devices, ensuring that they meet international standards before being shipped abroad. This measure is expected to bolster the confidence of manufacturers and improve the overall quality of products in the global market.

Collaboration with Other Ministries

TRAI has also advised the DoT to collaborate with other central ministries, including Finance and Commerce, to develop a harmonized framework. This framework would cover both the import of foreign SIM and eSIM cards for export-oriented devices and the export of Indian SIM and eSIM cards for devices intended for import markets. Such coordination is essential to create a cohesive regulatory environment that addresses security and compliance concerns while promoting international trade.

The regulator believes that a clear and effective regulatory framework is vital for supporting exports in the M2M and IoT sectors. By addressing these issues, TRAI aims to enhance the competitiveness of Indian products on the global stage, aligning with the government’s Make in India initiative.
