TRAI Issues Recommendations on Terms and Conditions for Assignment

The Telecom Regulatory Authority of India (TRAI) has unveiled its recommendations regarding the terms and conditions for assigning spectrum for satellite-based commercial communication services. This move comes in response to a request from the Department of Telecommunications (DoT) to ensure fair competition with terrestrial services. The recommendations cover various satellite communication services, including both non-geostationary and geostationary satellite systems, and aim to establish a clear framework for spectrum pricing and assignment.
Consultation Process and Stakeholder Engagement
TRAI initiated a consultation process by releasing a paper on September 27, 2024, inviting comments from stakeholders on 21 specific issues related to spectrum assignment. The original deadlines for submitting comments and counter-comments were set for October 18 and October 25, 2024, respectively. However, in response to requests from stakeholders, these deadlines were extended to October 25 and November 1, 2024. A total of 30 stakeholders provided comments, while 12 submitted counter-comments. To further engage with stakeholders, TRAI hosted an open house discussion on November 8, 2024, conducted virtually. This collaborative approach aimed to gather diverse perspectives and insights to inform the final recommendations.
Key Recommendations for Spectrum Assignment
TRAI’s finalized recommendations outline specific frequency bands for different types of satellite services. For non-geostationary satellite services (NGSO) providing data communication and internet services, the recommendations suggest using frequency spectrum in the Ku, Ka, and Q/V bands. For mobile satellite services (MSS), both NGSO and geostationary satellite services (GSO) should consider the L and S bands for user links, while feeder links should utilize the C, Ku, Ka, and Q/V bands. The recommendations propose a spectrum assignment period of up to five years, with a possible extension of two years based on market conditions. Furthermore, any revisions to the terms and conditions after this period would apply to all authorized entities, ensuring a level playing field.
Pricing Structure and Payment Terms
The recommendations also detail the pricing structure for spectrum assignment. For GSO-based fixed satellite services (FSS), a charge of 4% of Adjusted Gross Revenue (AGR) is proposed, with a minimum annual spectrum charge of โน3,500 per MHz. For NGSO-based FSS, the same percentage applies, along with an additional charge of โน500 per subscriber per annum in urban areas, while rural and remote areas are exempt from this charge. The pricing for GSO/NGSO-based MSS follows a similar structure. Payment terms stipulate that AGR-based charges should be paid quarterly in advance, while minimum spectrum charges are due at the time of assignment and annually thereafter. The government may also consider providing subsidies for user terminals in underserved regions.
Future Considerations and Coordination Requirements
To mitigate potential interference and enhance coordination among satellite operators, the recommendations emphasize the need for good faith collaboration among authorized entities. The government, with the assistance of the Telecom Engineering Center (TEC), is tasked with examining the necessity of a framework for spectrum sharing, including conditions for maximum equivalent power flux density (EPFD). Additionally, the recommendations suggest that satellite earth station gateways should be established within 12 months of receiving permission from the government. The DoT is also encouraged to assess the need for guidelines regarding coordination distances between satellite earth station gateways operating on the same frequencies. These measures aim to ensure efficient use of spectrum and foster a cooperative environment among satellite service providers.
