Priya Kapur’s ‘Position Swap’ Defense Hits Roadblock in Sunjay Kapur Will Case

The legal battle surrounding the will of the late industrialist Sunjay Kapur has escalated in the Delhi High Court, drawing significant attention due to its implications for his children with actress Karisma Kapoor, Samaira and Kiaan. Recent court proceedings have raised serious questions about the credibility of Priya Kapur’s defense, particularly her claims regarding her corporate role and actions following Sunjay’s death. As the case unfolds, the court is scrutinizing the circumstances surrounding a contested will and the actions of the appointed executor, which may have far-reaching consequences for the Kapur family’s legacy.

Challenge to Priya Kapur’s Claims

During the recent hearings, senior advocate Mahesh Jethmalani, representing Sunjay Kapur’s children, challenged Priya Kapur’s assertion that her departure from Automotive India Pvt Ltd (AIPL) was a consensual “position swap.” Jethmalani argued that her removal on May 31, 2023, was a direct result of marital discord rather than a smooth transition. He pointed out that corporate records do not support her claim of becoming the Managing Director of Raghuvanshi Investment Pvt Ltd (RIPL) or holding any significant role in the company. This contradiction raises doubts about her narrative of a harmonious family dynamic, especially as she has frequently referenced her cordial relationship with Karisma Kapoor‘s children.

The timeline of events following Sunjay’s death in June 2023 has come under intense scrutiny. Jethmalani highlighted that Priya was appointed as a director of AIPL just one day after Sunjay’s passing and quickly reinstated herself as Managing Director within a week. He argued that this sequence of events suggests opportunism rather than continuity, stating, “She was not in control when Sunjay was alive. She sought control only after his passing.” This assertion casts a shadow over her claims of a stable family environment and raises questions about her motivations.

Discrepancies in the Executor’s Conduct

The role of the named executor, Shradha Suri Marwah, has also come under fire during the proceedings. According to the submissions presented in court, Marwah failed to pursue probate or manage Sunjay’s assets as required by law. Jethmalani contended that an executor cannot selectively enforce parts of a will, emphasizing the importance of adhering to legal protocols in such matters. The court was informed that Marwah claimed to have “deleted” a crucial email attachment that allegedly contained the contested will, despite the email itself being available in court.

Jethmalani pointed out the implausibility of Marwah’s explanation, stating, “You cannot delete the attachment without deleting the email.” This raises significant concerns about the integrity of the will and the actions taken by the executor. The disappearance of a supporting document that was present in an earlier email but missing in the final version adds another layer of complexity to the case, further complicating the legal landscape surrounding Sunjay Kapur’s estate.

Implications for Sunjay Kapur’s Legacy

As the court prepares to reconvene on December 22, the focus will remain on the inconsistencies surrounding Priya Kapur’s corporate role, her actions following Sunjay’s death, and the missing email attachment. These issues are central to the ongoing dispute, which carries significant implications for Sunjay Kapur’s children and the businesses he once led. The outcome of this legal battle could shape the future of the Kapur family’s legacy and determine the rightful heirs to Sunjay’s substantial estate.

The case has not only captured the attention of the legal community but also the public, given its connections to the high-profile figures involved. As the proceedings continue, all eyes will be on the Delhi High Court to see how it navigates the complexities of this contentious dispute and what it ultimately means for the Kapur family.
