New Criminal Laws Strengthen Protections for Women and Children

The Bharatiya Nyaya Sanhita (BNS) 2023 introduces significant reforms aimed at enhancing the protection of women and children in India. For the first time, crimes against these vulnerable groups are prioritized under a dedicated chapter, with stringent penalties, including life imprisonment and the death penalty for severe offenses. The legislation also addresses human trafficking and incorporates new definitions and protections to ensure justice and support for victims.

Enhanced Penalties for Crimes Against Women

The BNS 2023 places a strong emphasis on crimes against women, establishing a new Chapter-V that prioritizes these offenses above others. Notably, the law stipulates severe punishments for gang rape, particularly for victims under 18 years of age, mandating life imprisonment or even the death penalty for offenders. Additionally, the legislation introduces a new offense for sexual intercourse based on false promises, such as marriage or employment, thereby expanding the scope of legal protections for women.

In a significant shift, the BNS has made various offenses gender-neutral, ensuring that all victims and perpetrators are treated equally under the law, regardless of gender. This change aims to create a more inclusive legal framework that recognizes the complexities of gender-based violence. Furthermore, the law eliminates age differentials for minor victims of gang rape, ensuring consistent and severe penalties for all cases involving victims under 18.

Stricter Measures Against Human Trafficking

The BNS 2023 also addresses the critical issue of human trafficking, with Section 143 imposing strict penalties, including life imprisonment for offenders. Trafficking of children is treated with particular severity, carrying a minimum sentence of 10 years, which can extend to life imprisonment. The law recognizes ‘beggary’ as a form of exploitation linked to trafficking, thereby broadening the scope of offenses punishable under this section.

Moreover, Section 144 (1) introduces stringent penalties for the sexual exploitation of trafficked children, with a minimum sentence of five years, extendable to life imprisonment. These provisions reflect the government’s commitment to combat human trafficking and provide robust protections for the most vulnerable members of society.

Comprehensive Protections for Victims

The BNS 2023 outlines several measures aimed at protecting victims of crimes against women and children. Victims’ statements will now be recorded through audio-visual means to ensure transparency and accuracy during investigations. Additionally, the law mandates that, where possible, a woman magistrate must record the victim’s statement, fostering a supportive environment for those coming forward with allegations of sexual violence.

Medical practitioners are also required to submit medical reports for rape victims to investigating officers within seven days, ensuring timely documentation of evidence. The legislation further stipulates that certain vulnerable individuals, including minors and the elderly, should not be compelled to attend police stations unless they choose to do so, thereby reducing the burden on these groups during investigations.

Importantly, the BNS guarantees free medical treatment for victims of crimes against women and children at all hospitals, ensuring immediate access to necessary care. This provision underscores the government’s commitment to prioritizing the health and recovery of victims during challenging times.

Government’s Commitment to Reform

These significant reforms were highlighted by the Minister of State in the Ministry of Home Affairs, Shri Bandi Sanjay Kumar, during a recent session in the Lok Sabha. The introduction of the BNS 2023 marks a pivotal step in India’s legal landscape, aiming to create a safer environment for women and children while addressing the pressing issues of gender-based violence and human trafficking.
