Increased US Visa Refusals for Indians Linked to Social Media Scrutiny
Many Indians seeking to travel to the United States are currently facing significant delays in their visa applications. This situation has arisen due to increased scrutiny over social media activity and past arrests, which has slowed down processing times. The tightening of visa norms, particularly since President Donald Trump took office in January 2025, has led to a rise in temporary visa refusals, known as 221(g) notices. These developments have left numerous applicants in limbo, struggling to navigate the complexities of the visa process.
Increased Scrutiny and Delays
The U.S. visa application process has become more challenging for many Indians, who represent over 70% of H-1B visa holders in the fiscal year 2024. The implementation of stricter measures has resulted in a notable increase in the issuance of 221(g) notices. These notices allow consular officers to temporarily refuse visas while they verify applicants’ backgrounds. Experts have observed that even cases that previously would not have triggered such notices are now facing delays. Joel Yanovich, an attorney at Murthy Law Firm, noted that there is a higher rate of 221(g) notices being issued, indicating that many applicants are encountering further delays even after securing an appointment.
Impact of Past Arrests
The current administration’s policies have led to unprecedented denials for applicants with prior arrest records, even if those records are over a decade old. Gnanamookan Senthurjothi, founder of the Visa Code, highlighted that applicants who had previously received multiple visa stampings are now facing 221(g) notices. This shift has left many individuals with valid documents in a precarious situation, as their visas are being revoked without clear explanations. The uncertainty surrounding the application process has left hundreds of Indians stranded, unable to return to the U.S. or proceed with their plans.
Lengthening Processing Times
The visa application process is now taking significantly longer due to the additional scrutiny placed on each case. Xiao Wang, founder of Boundless Immigration, explained that all applications are subject to detailed social media vetting, which has resulted in longer evaluation times. This increased scrutiny has slowed down the entire process, leading to widespread delays. Appointments that were initially scheduled have also faced rescheduling, with many pushed back to later dates. In early December, a wave of appointment cancellations occurred, further complicating the situation for applicants who had already made travel plans.
Additional Documentation Requirements
Applicants receiving 221(g) notices are now being asked to provide additional documentation, including toxicology reports and police records. While this requirement may help in processing applications, it has also added to the burden on applicants. Senthurjothi emphasized that despite these steps forward, hundreds of Indians remain affected by the ongoing delays and complications in the visa application process. The combination of increased scrutiny, past arrest considerations, and lengthy processing times has created a challenging environment for those hoping to travel to the United States.
