CCPA Slaps ₹10 Lakh Fine on Dial4Trade for Unsafe Sales
The Central Consumer Protection Authority (CCPA) has imposed a hefty fine of ₹10 lakh on Dial4Trade Technologies Private Limited for breaching consumer safety laws. The penalty was announced after the platform facilitated the online sale of Ammonium Nitrate without necessary regulatory safeguards. The CCPA’s ruling highlights its commitment to public safety and consumer rights, particularly regarding hazardous products.
The Authority, headed by Chief Commissioner Smt. Nidhi Khare and Commissioner Shri Anupam Mishra, issued a final order under the Consumer Protection Act, 2019, citing the lack of essential protective measures in Dial4Trade’s operations. As part of the ruling, Dial4Trade must discontinue listing, hosting, and selling Ammonium Nitrate or any other substance classified as explosives under the Explosives Act, 1884, immediately.
Missing Safeguards Raise Concerns
During its investigation, the CCPA discovered several alarming deficiencies in Dial4Trade’s practices. Notably, the platform failed to require valid licenses from sellers, did not verify the identity of buyers, and lacked mechanisms for transaction traceability as mandated by the Ammonium Nitrate Rules, 2012. The listings included promotional images suggesting explosion effects, which could mislead customers about the product’s dangers.
The CCPA classified the online listings as advertisements, categorizing the manner in which Dial4Trade presented Ammonium Nitrate akin to that of an ordinary consumer product. This misleading representation, absent necessary disclosures about licensing requirements, was deemed a significant unfair trade practice and a violation under the Consumer Protection Act.
Dial4Trade’s Defense Rejected
Dial4Trade argued that as a Business-to-Business (B2B) platform, it should not be held accountable for listings from third-party sellers. The CCPA rejected this defense, noting the platform’s capability to allow sales of single units and the absence of appropriate verification mechanisms typically found in B2B marketplaces.
The CCPA underscored that the Consumer Protection (E-Commerce) Rules, 2020, apply to all marketplace entities, regardless of their claimed business models. By failing to enforce due diligence in the listings of hazardous materials, Dial4Trade jeopardized public safety.
Wider E-Commerce Scrutiny in Progress
This action against Dial4Trade is part of a broader initiative by the CCPA to investigate various e-commerce platforms involved in the unauthorized sale of hazardous chemicals, including Gun Powder and Picric Acid. Other platforms currently under scrutiny include India MART, Justdial, and TradeIndia.
The CCPA reiterated the necessity for e-commerce platforms to exercise diligence in their operations, especially concerning regulated and potentially dangerous products. The Authority remains dedicated to upholding consumer rights and preventing unfair trade practices to protect public safety.
