Allegations of Bribery in Indian Solar Power Sector

The solar power sector in India is facing serious allegations of bribery involving major players like Adani Green and Azure Power. A recent complaint filed by the U.S. Securities and Exchange Commission (SEC) in a New York court has shed light on these troubling claims. The complaint details how the Solar Energy Corporation of India (SECI) struggled to finalize power purchase agreements (PPAs) with these companies due to high tariffs. The situation escalated, leading to accusations that substantial bribes were paid to government officials to secure these deals. Delays in Power Purchase Agreements

This agreement followed reports of payments amounting to hundreds of thousands of dollars to government officials. By December 2021, SECI had entered into PSAs with distribution companies (discoms) in at least four states. The SEC and the U.S. Department of Justice (DoJ) have also alleged that bribes were paid to officials in Tamil Nadu, Chhattisgarh, and Jammu & Kashmir. These revelations raise serious questions about the integrity of the bidding process and the ethical standards of the companies involved.

Pressure Tactics and Alleged Bribery

In late 2020 and early 2021, Sagar Adani, along with his uncle Gautam Adani, reportedly communicated with Azure executives about the need to “pressure and incentivize” state officials. The SEC alleges that by June 2021, Azure publicly acknowledged the challenges they faced in securing agreements. Shortly thereafter, Gautam and Sagar Adani intensified their efforts to persuade Indian state officials.

The complaint claims that through personal involvement and promises of substantial bribes, the Adani Group managed to secure agreements from some discoms. In August 2021, Gautam Adani allegedly met with the then Chief Minister of Andhra Pradesh, Jagan Mohan Reddy, to discuss these matters. The SEC claims that approximately โ‚น1,750 crore (around $210 million) of the total โ‚น2,029 crore (approximately $245 million) paid in bribes was directed to officials in Andhra Pradesh, who agreed to purchase 7,000 MW of power in the first phase. These allegations paint a troubling picture of how business practices may have undermined the integrity of the renewable energy sector in India.

Responses and Implications for the Industry

In response to these serious allegations, the Adani Group has categorically dismissed the charges as baseless. They assert that both Adani Green and Azure Power were beneficiaries of the initial production-linked incentive schemes, which required them to establish significant generation capacities. Adani Green, for instance, expanded its renewable power capacity from 20 MW to 10 GW by 2022, largely due to its participation in SECI contracts.

The implications of these allegations are far-reaching. If proven true, they could tarnish the reputations of the companies involved and undermine public trust in the renewable energy sector. Moreover, such scandals could deter foreign investment and slow down the progress of renewable energy initiatives in India.
