The National Human Rights Commission (NHRC) of India recently convened a core group meeting in New Delhi to discuss the pressing issue of disability rights. The meeting, held in a hybrid format, focused on “Recognizing Progressive Disabilities – Adopting a Holistic Approach to Disability Rights.” Chaired by NHRC Chairperson Justice V. Ramasubramanian, the meeting brought together various stakeholders, including government officials, medical professionals, and domain experts. The discussions aimed to evaluate existing laws and policies while exploring ways to enhance the lives of persons with disabilities (PwDs) in India.
Historical Context of Disability Rights in India
Justice Ramasubramanian highlighted the significant progress made over the past three decades in adopting a human rights approach to disability rights. He pointed out that India has made strides in this area, paralleling international developments. Key legislative milestones include the 1987 Mental Healthcare Act, the 1995 Persons with Disabilities Act, and the 2016 Rights of Persons with Disabilities Act. These laws have laid the groundwork for protecting the rights of individuals with disabilities.
Despite these advancements, Justice Ramasubramanian emphasized that there is still room for improvement. He called for a thorough review of existing laws and policies to identify gaps and areas needing enhancement. To achieve this, he suggested that stakeholders prioritize their recommendations and categorize them into three distinct areas: those requiring parliamentary intervention, those needing NHRC involvement, and those necessitating judicial action. This structured approach aims to create a clear action plan for advancing disability rights in India.
The Role of Stakeholders in Enhancing Disability Rights
Justice (Dr) Bidyut Ranjan Sarangi, a member of the NHRC, stressed the importance of collaboration among all stakeholders, including government entities, to improve the lives of persons with disabilities. He pointed out that moral support is essential for PwDs to live with dignity. One of the critical issues raised was the burden of medical expenses faced by individuals with disabilities. Addressing this concern is vital for ensuring that they receive the necessary care and support.
Shri Bharat Lal, the NHRC Secretary General, outlined the agenda for the meeting, which included discussions on defining and classifying progressive disabilities, the legal and policy framework addressing disabilities, and promoting inclusive support services. He emphasized the need for a comprehensive approach that involves various stakeholders, including government officials, researchers, and community workers, to create effective solutions for the challenges faced by PwDs.
Current Challenges and Future Directions
Shri Rajesh Aggarwal, Secretary of the Department of Empowerment of Persons with Disabilities, presented data from the 2011 Census, which indicated that 2.2% of India’s population has disabilities. However, he noted that stigma often leads to under-reporting, particularly among the elderly. He highlighted the need for better accessibility in public spaces, transportation, and digital platforms, as India currently lags behind many European countries in these areas.
The discussions also revealed several suggestions for improving the situation for persons with disabilities. These included encouraging collaboration with the private sector for quality employment, revisiting the criteria for benchmark disabilities, and enhancing healthcare and rehabilitation provisions. Additionally, there was a call for clearer definitions of progressive disabilities and the promotion of assistive technologies. The NHRC plans to further deliberate on these suggestions and gather more input from stakeholders to finalize recommendations aimed at protecting the rights of persons with disabilities in India.
