Bank Robbery Leads to Stolen Gold Case Outcomes Revealed
A recent ruling by the Karnataka State Disputes Redressal Commission has clarified the responsibilities of banks regarding gold jewellery pledged as collateral for loans. The case arose when a Tumkur resident’s gold, held by Canara Bank, was stolen during a robbery. The commission ruled that the bank must compensate the borrower not only for the gold’s value but also for making charges and the value of any stones.
Background of the Case
In August 2017, the borrower opened two gold loan accounts with Canara Bank, pledging jewellery weighing a total of 253.80 grams. After the gold was stolen, the bank offered compensation based on the gold’s weight, paying Rs 1,56,033 for the first account and Rs 2,12,500 for the second. However, the borrower sought additional compensation for making charges and the value of stones, totaling Rs 88,362.
District Commission’s Ruling
The District Commission ruled in favor of the borrower in July 2020, ordering the bank to pay the additional amount along with Rs 30,000 for compensation and Rs 10,000 for litigation costs. The commission found that the bank had not adequately compensated the borrower for the making charges and stone value.
Bank’s Appeal
Canara Bank contested the District Commission’s decision, arguing that it had fulfilled its obligation by paying the value of the gold. The bank claimed there was no deficiency in service and that the additional claims lacked proper documentation.
State Commission’s Decision
The Karnataka State Disputes Redressal Commission upheld the District Commission’s ruling, stating that the bank must settle the value of the jewellery at prevailing rates, including making charges and stone value. The commission emphasized that banks have a duty to compensate for losses incurred while holding customers’ valuables. Consequently, Canara Bank was ordered to pay the borrower Rs 88,362, along with 9% interest, Rs 30,000 for compensation, and Rs 10,000 for litigation expenses.
