DPDP Regulations Take Effect: Understand Your Personal Data Management
India has officially launched a new framework for data protection with the implementation of the Digital Personal Data Protection (DPDP) Rules 2025. This initiative, spearheaded by the Ministry of Electronics and Information Technology (MeitY), aims to enhance citizens’ control over their personal data while establishing clear responsibilities for organizations that manage this information. The DPDP Rules are designed to apply to a wide range of entities, including social media platforms and digital services, ensuring transparency in data collection and usage.
How Organisations Must Handle Personal Data
The DPDP Rules 2025 lay out specific guidelines for the collection, processing, security, and retention of personal data. Both government agencies and private organizations are mandated to adhere to these standards. Data Fiduciaries, which are entities that determine how data is processed, must implement robust security measures to safeguard against breaches. This includes employing techniques such as encryption, masking, obfuscation, tokenization, and enforcing strict access controls.
Furthermore, organizations are required to continuously monitor data handling practices, maintain activity logs for at least one year, and ensure secure data backups. Contracts with Data Processors must incorporate essential security clauses. In the event of a data breach, Data Fiduciaries are obligated to promptly notify affected users, detailing the nature of the breach, potential risks, remedial actions taken, and providing contact information for further assistance. Additionally, breaches must be reported to the Data Protection Board within a 72-hour timeframe.
Rules for Children’s Data
The DPDP Rules impose heightened responsibilities on organizations that handle data pertaining to children. Specifically, any personal data belonging to individuals under the age of 18 can only be processed after obtaining verifiable parental consent. Data Fiduciaries are required to verify the identity and age of the parent or guardian using reliable methods, such as verified virtual tokens or identity checks based on Digital Locker systems. Without this verified consent, companies are prohibited from collecting or processing any personal data of minors.
Transfer of Data Outside India
Under the DPDP Rules 2025, organizations are permitted to transfer personal data outside of India, but only under conditions set forth by the central government. Such transfers must comply with requirements specified through general or special orders, ensuring that there is adequate oversight when sharing data with foreign entities or states. This provision aims to protect the integrity and security of personal data even when it is processed beyond national borders.
Implementation Timeline
Although the DPDP Rules have been officially notified, their implementation will occur in phases. Some sections of the Act are effective immediately, while others will be rolled out over the next 12 to 18 months. This staggered approach allows organizations the necessary time to adjust their systems to meet the new requirements. During this transitional period, companies must focus on issuing clear notices to users, maintaining security standards, promptly reporting breaches, responsibly managing data retention, and facilitating user access to their data for correction or deletion. Additionally, entities classified as Significant Data Fiduciaries will have to meet further obligations as part of this new regulatory framework.
